I have
read and accept the following terms and grant
ALLMYPOINTS for ALLMYPOINTS LLC. the rights described
below. I authorize ALLMYPOINTS to access and obtain my
points program account information from the reward
programs described on this registration form, as the
same may be amended from time to time. For all purposes
hereof, ALLMYPOINTS is granted a limited power of
attorney, and I hereby appoint ALLMYPOINTS as my true
and lawful attorney-in-fact and agent, with full power
of substitution and resubstitution, for me and in my
name, place and stead, in any and all capacities, to
access such data from the points programs at all times
as ALLMYPOINTS may determine in its sole discretion,
with the full power and authority to do and perform each
and every act and things requisite and necessary to be
done in connection with such access, as fully to all
intents and purposes as I might or could do in person.
ALLMYPOINTS is further authorized to utilize such
information in preparing reports regarding my accounts
and can consolidate this information for ALLMYPOINTS'
use as it determines in its sole discretion. I
understand that ALLMYPOINTS acts solely as an
intermediary, that my benefits are subject to the reward
program sponsors' individual terms and restrictions, and
that ALLMYPOINTS has no authority to access, direct or
divert any program awards or other benefits. I further
understand that ALLMYPOINTS has no relationship to or
connection with any airline, hotel, car rental or other
reward program sponsor, and agree that ALLMYPOINTS
assumes no responsibility and shall incur no liability
with respect to the acts, omissions or determinations of
any program sponsor. This limited power of attorney will
cease to exist immediately upon the termination of my
membership with ALLMYPOINTS.
To
cancel your subscription, please send an e-mail to
support@allmypoints.com indicating that you wish to
cancel, and ALLMYPOINTS will cancel your subscription.
Please be sure to send the email from the email address
that corresponds with the respective User ID.
You
will choose a password when registering. You are
responsible for maintaining the confidentiality of your
password and account. You are fully responsible for all
activities that occur using your password or account.
Please notify ALLMYPOINTS immediately of any
unauthorized use of your password or account or any
other breach of security. You may not use anyone else's
password at any time. ALLMYPOINTS employees do not have
access to your third party site user names and
passwords. Furthermore, no ALLMYPOINTS employee can view
or retrieve your password. Should you forget your
password, you will need to answer a password prompt
question. Once you answer the question correctly, the
system will email your password to your email address on
record. If you have forgotten the answer to your
retrieval question, or if you do not know your User
Name, please contact customer service.
These
Terms may be updated from time to time. Upon any change,
ALLMYPOINTS will notify you by email or by a link to the
new or different Terms. If you continue to use
ALLMYPOINTS' services, your continued use of the
services constitutes acceptance of the changes as
amended. If you do not agree to the changes, you agree
to discontinue your use of the ALLMYPOINTS service.
ALLMYPOINTS reserves the right to change or discontinue,
temporarily or permanently, the service at any time
without notice. ALLMYPOINTS will not be liable to you or
any third party for any modification or discontinuance
of the service.
Personal information collected by ALLMYPOINTS may be
stored and processed in the United States or any other
country in which ALLMYPOINTS LLC. or its agents maintain
facilities. By using ALLMYPOINTS, you consent to any
such transfer of information outside of your country.
As
consideration for using the Service, you agree and
understand that ALLMYPOINTS will display advertisements
and other information adjacent to and related to member
profiles. ALLMYPOINTS serves relevant ads using a
completely automated process that enables ALLMYPOINTS to
effectively target dynamically changing content. No
personally identifiable information will be provided to
advertisers as part of the Service.
Information about the activity of members on the
ALLMYPOINTS site is automatically generated when you log
in to your account. We may review and analyze your use
of products and services, including transactions in your
accounts, to help protect you from unauthorized use of
your accounts, to help us serve you better, and to tell
you about other products and services. We use this
information for internal review in aggregate. We use
this information to support your member relationship
with us and improve your experience in using our web
site. We personalize your experience by using your
information to make recommendations of services that
might interest you. On occasion we may use the
information we collect to notify you occasionally of
important changes to the web site, ALLMYPOINTS services
and special offers we think you will find valuable. Only
ALLMYPOINTS (or people working on behalf of ALLMYPOINTS)
will send you these communications.
Our web site uses session and persistent "cookies".
"Cookies" are small pieces of information stored by your
browser on your computer's hard drive. Most web browsers
automatically accept cookies, but you can usually change
your browser to prevent that.
Session Cookies are used by ALLMYPOINTS to remember you
as you visit pages in our site, so that you do not have
to re-enter your password & username many times. Session
Cookies do not contain any personally identifying
information. Once you shut your browser, these cookies
no longer function or have any effect.

ALLMYPOINTS, we are dedicated to protecting our
customer's privacy. Our Privacy Policy sets forth
ALLMYPOINTS' commitment to you to protect the privacy of
your individual information that is collected through
the ALLMYPOINTS service. Because protecting your privacy
is very important to us, we are committed to protecting
the confidentiality of your individual information.

After a
period of inactivity, ALLMYPOINTS reserves the right to
disable or terminate a user's account. If an account has
been deactivated for inactivity, an account can be
re-opened at a later date.
You
agree to hold harmless and indemnify ALLMYPOINTS, and
its subsidiaries, affiliates, officers, agents, and
employees from and against any third party claim arising
from or in any way related to your use of the Service,
including any liability or expense arising from all
claims, losses, damages (actual and consequential),
suits, judgments, litigation costs and attorneys' fees,
of every kind and nature. In such a case, ALLMYPOINTS
will provide you with written notice of such claim, suit
or action.
These
Terms & Conditions will be governed by and construed in
accordance with the laws of the State of Florida,
without giving effect to its conflict of laws provisions
or your actual state or country of residence. Any
claims, legal proceeding or litigation arising in
connection with the Service will be brought solely in
Miami-Dade County, Florida, and you consent to the
jurisdiction of such courts.
